Drug Court in New Jersey

New Jersey’s Drug Court program is a specialized court-supervised treatment program for defendants whose criminal charges are driven by substance abuse and addiction. Rather than incarceration, Drug Court offers intensive treatment, monitoring, and support — with the goal of addressing the underlying addiction and breaking the cycle of substance abuse and crime. For eligible defendants, Drug Court can mean the difference between prison and recovery.

What Is Drug Court?

New Jersey Drug Court operates under N.J.S.A. 2C:35-14 and is administered through the Superior Court in each county. It is a voluntary, highly structured program that typically lasts 18 months to 5 years. Defendants who successfully complete Drug Court may have their charges dismissed or receive a significantly reduced sentence.

Drug Court is not a traditional diversionary program like PTI or Conditional Discharge — it is a sentencing alternative for defendants who have been convicted or are pleading guilty, and who have serious addiction issues that drove the criminal conduct. Judges, prosecutors, defense attorneys, treatment providers, and probation officers all work together as a team to support the defendant’s recovery.

Who Is Eligible for Drug Court?

Drug Court in New Jersey is generally available to defendants who:

  • Are charged with or have been convicted of a drug offense or a crime that was motivated by drug addiction (such as theft to fund drug use)
  • Are assessed as having a genuine substance use disorder requiring treatment
  • Have not been convicted of a violent crime or a crime that triggers a mandatory period of parole ineligibility (in most cases)
  • Are willing to voluntarily participate in the program
  • Have not previously failed out of Drug Court

The eligibility assessment includes a clinical evaluation to confirm the presence of a substance use disorder. Defendants are screened by the Drug Court team, which includes the prosecutor, the defense attorney, and the Drug Court coordinator.

How Does the Drug Court Program Work?

Drug Court operates in structured phases, typically four or five phases over the course of the program. Early phases involve more intensive monitoring and treatment; later phases step down as the defendant demonstrates sustained sobriety and stability. Throughout the program:

  • Defendants appear before the Drug Court judge regularly — weekly or biweekly in early phases
  • Random drug testing is required
  • Participants must attend treatment (inpatient, outpatient, or both depending on need)
  • Employment, education, and housing stability are addressed as part of recovery
  • Support services including mental health treatment, family counseling, and vocational training may be incorporated
  • Sanctions (short jail stays, increased monitoring) are imposed for relapses; achievements are recognized and rewarded

The Drug Court judge plays an active, engaged role — meeting with each participant regularly and holding them accountable while also providing encouragement and support. This model is fundamentally different from traditional criminal court proceedings.

What Are the Benefits of Drug Court?

For eligible defendants, Drug Court offers significant advantages over traditional prosecution:

  • Avoid incarceration: Defendants who would otherwise face prison sentences can complete treatment in the community instead.
  • Address the root cause: Drug Court treats addiction, not just the criminal charge — giving participants the best chance of sustained recovery and law-abiding behavior.
  • Reduced or dismissed charges: Successful completion can result in dismissal of charges or a substantially reduced sentence.
  • Support services: Drug Court connects participants with housing, employment, counseling, and other resources that are otherwise hard to access.

What Happens If You Don’t Complete Drug Court?

Drug Court is demanding. Participants who repeatedly fail drug tests, miss appearances, or otherwise fail to comply with the program may be terminated and returned to traditional criminal proceedings to face the charges they were originally diverted from. The program involves a genuine commitment — it is not a shortcut. Defendants who enter Drug Court must be prepared to do the hard work of recovery.

Drug Court in Hunterdon County operates through the Hunterdon County Superior Court at 65 Park Avenue, Flemington. Cases involving defendants from throughout Hunterdon County — including Clinton Township, Flemington, Readington, Lambertville, and surrounding areas — are handled at this location.
