Underage DWI in New Jersey

New Jersey applies a stricter standard to drivers under 21 years old when it comes to DWI. If your child or you as a driver under 21 has been charged with an underage DWI, it is critical to understand how this charge works and why even a “low BAC” case deserves serious attention.

New Jersey’s Zero Tolerance Law for Underage Drivers

Under New Jersey law (N.J.S.A. 39:4-50.14), it is unlawful for a person under 21 to operate a motor vehicle with a BAC of 0.01% or higher. This is a dramatically lower threshold than the standard 0.08% limit that applies to adult drivers. A single drink can put an underage driver over the 0.01% limit.

The underage DWI statute is separate from the standard DWI statute and carries its own distinct set of penalties — but an underage driver can also be charged under the standard DWI statute if their BAC meets or exceeds 0.08%.

Penalties for Underage DWI in New Jersey

For a first offense under the zero tolerance law (BAC 0.01% to 0.07%):

  • License suspension: 30 to 90 days
  • Community service: 15 to 30 days
  • Participation: Required attendance in an Intoxicated Driver Resource Center (IDRC) program
  • No fine under the underage statute itself — but court costs and surcharges apply

If the BAC is 0.08% or higher, the driver faces the full adult DWI penalties in addition to the underage charge. This includes fines, potential jail time, a 7-month to 1-year license suspension, ignition interlock device requirements, and a $1,000/year insurance surcharge for 3 years.

The Long-Term Consequences of an Underage DWI

Even though a New Jersey DWI is a motor vehicle offense rather than a criminal charge, the consequences for a young driver can be far-reaching:

  • Driving record: The DWI appears on the driver’s abstract and is visible to insurance carriers permanently.
  • Insurance: Auto insurance premiums will increase dramatically — often doubling or tripling — and some carriers will drop the driver entirely.
  • College and professional applications: Some colleges, graduate programs, and professional licensing boards inquire about motor vehicle violations. A DWI on a young person’s record at 18 or 19 can affect applications for years.
  • Second offense risk: Because a first DWI is on the record permanently, any future DWI charge will be treated as a second offense — with 2-year license suspension and mandatory jail time — even years later.

College Students and DWI Charges

Hunterdon and Somerset counties are home to a number of college students — some attending local schools, others home from school. DWI charges for college students carry the added risk of college disciplinary proceedings, potential suspension or expulsion, loss of financial aid, and damage to academic records in addition to the legal consequences.
