First DWI in New Jersey? Here’s What You’re Up Against — And What You Can Do About It

If you’ve just been charged with your first DWI in New Jersey, you’re probably scared. Maybe you’re embarrassed. Maybe you’re wondering if your life is about to fall apart.

Take a breath. It’s serious — but it’s not the end of the world. And you have more options than you think.

New Jersey Calls It “DWI” — Not “DUI”

First thing: in New Jersey, the charge is Driving While Intoxicated (DWI) under N.J.S.A. 39:4-50. You’ll hear people say “DUI” — same thing, different name. What matters is that in NJ, a DWI is technically a traffic offense, not a criminal charge. That’s an important distinction, but don’t let it fool you into thinking it’s no big deal. The consequences are real.

What Are the Penalties for a First DWI in NJ?

The penalties depend on your Blood Alcohol Concentration (BAC) at the time of the stop. New Jersey breaks it into tiers:

BAC 0.08% – 0.10% (General Impairment)

  • No license suspension — thanks to a 2019 law change, first-time offenders in this range keep their license
  • 3 months with an ignition interlock device (IID) installed on your car
  • Fines: $250–$400
  • Up to 30 days in jail (though jail time for first offenses at this level is uncommon)
  • 12–48 hours at the Intoxicated Driver Resource Center (IDRC)

BAC 0.10% – 0.15% (Elevated)

  • License suspension possible
  • 7–12 months with an ignition interlock device
  • Fines: $300–$500
  • Up to 30 days in jail
  • 12–48 hours at the IDRC

BAC Above 0.15% (High BAC)

  • 4–6 month license suspension
  • 9–15 months with an ignition interlock device
  • Fines: $300–$500
  • Up to 30 days in jail
  • 12–48 hours at the IDRC

The Costs Add Up Fast

The fines the court imposes are just the beginning. Here’s what a first DWI really costs:

  • Insurance surcharges: $1,000 per year for three years — that’s $3,000 on top of everything else
  • IDRC fees: Around $280
  • Additional surcharges (Neighborhood Services Fund, Alcohol Education and Rehabilitation Fund): About $175
  • Ignition interlock installation and monitoring: Several hundred dollars
  • Attorney fees

When you add it all up, a first DWI in New Jersey can easily cost $10,000 or more.

Can a First DWI Be Expunged in New Jersey?

No. DWI convictions in New Jersey cannot be expunged because they’re classified as traffic violations, not criminal offenses. The NJ expungement statute only covers criminal charges. A DWI stays on your driving record permanently.

This is one of the biggest reasons to fight the charge — not just plead guilty and hope for the best.

Why You Need an Attorney for a First DWI

People assume a first offense means there’s nothing to fight. That’s not true. Here’s what an experienced DWI defense attorney looks at:

  • Was the traffic stop legal? Police need a valid reason to pull you over. If they didn’t have one, everything that came after could be thrown out.
  • Was the field sobriety test administered correctly? These tests have strict protocols. Officers get them wrong more often than you’d think.
  • Was the breathalyzer properly calibrated and maintained? The Alcotest machine has specific calibration and maintenance requirements. If those weren’t followed, the BAC reading may not hold up.
  • Were your rights protected? From the moment you were stopped to the moment you were charged, there are procedures that must be followed.
